A. Farber & Partners helps corporations and lenders through tough times
In today’s challenging and competitive environment, businesses can face many adverse situations, including:
- Negative market conditions
- The impact of offshore competition or a fluctuating Canadian dollar
- Deteriorating relationships with lenders or landlords
- Shareholder disputes
- Fraudulent activity
A. Farber & Partners helps navigate through these challenging times.
Corporations and shareholders engage A. Farber & Partners to deal with adversity and restructure its financial affairs.
Banks and other lenders (including asset based lenders, private equity firms, and hedge funds) engage us to deal with non-performing loans or investments.
Law firms engage A. Farber & Partners to provide financial expertise, strategic guidance and crisis management services to their clients in financial difficulty.
Accounting firms refer their clients to A. Farber & Partners when they do not provide insolvency services in-house, or have a conflict of interest. Since we provide no accounting, audit or tax services, we are able to work in partnership with other accounting firms for the benefit of their clients.
Strategic solutions are tailored to each situation and include:
- Filing under the Companies Creditor Arrangement Act ("CCAA") or filing a Proposal under the Bankruptcy & Insolvency Act ("BIA"). A filing under one of these statutes creates "breathing room" for a company and its advisors to formulate a restructuring plan. We help reposition the company for survival, attract new capital, sell non-strategic business units or redundant assets, or add management expertise and assist in communicating the plan to creditors and other stakeholders. We may also act as Chief Restructuring Officer ("CRO") when management requires assistance in implementing the plan.
- Formal insolvency engagements. We act as a Court Appointed or Privately Appointed Receiver or Interim Receiver or as Trustee in Bankruptcy. We work towards an orderly sale or wind-down of the business, maximizing the value of the assets.
- Turnaround management services. Our Turnaround Group draws from a network of turnaround experts to advise and implement financial and/or operational turnaround strategies. Our Corporate Finance group assists with divestures or the task of raising additional financing to continue operations.
- Distressed financial advisory services. We bring a broad range of expertise, strategic advice and sources of financing to distressed companies seeking to refinance or sell part or all of their business.
- Forensic accounting and fraud investigations. We examine and analyze business records to uncover a fraud and to trace and recover assets which are the proceeds of crime. In many cases these services are performed in our capacity as Court-Appointed Receiver or Trustee in Bankruptcy. We often also provide evidence as part of ongoing legal proceedings and have extensive experience in fraud investigations spanning multiple international jurisdictions.
A. Farber & Partners has a long history of success in helping distressed companies rebuild their operations and maximize value for all stakeholders.
